Green Card for Spouse of USC who Entered the US Without Inspection
Biden has announced a pla, to be implemented by executive order, that grants legal status to undocumented persons who;
Have been in the United States for a minimum of 10 years.
Are married to a U.S. Citizen,
Whose parent is married to a USC,
The immigrant and his or her children will eventually be elgible for Lawful Permanent Resident status and citizenship through naturalization.
This executive action if implemented will provide eligible immigrants with work permits and eligiblity for a driver’s license.
There will be details to be worked out on the specifics of the plan. For instance how long the immigrant is required to have been married to the USC? Is the immigrant with an outstanding removal order eligible? Is a person with a criminal record eligible?
Once the plan is in place it may be challenged in court and a temorary injuction to halt the action may be granted.
Biden tried a similar plan and the courts struck it down. DACA has gone through this process.
If granted this program will make the provisional waiver for the spouse of a USC obsolete.
Bottom line is we will all need to watch and wait.
