VAWA stands for, Violence Against Women Act. It is a federal law that was created in 1994 to address domestic violence, sexual assault, and other forms of gender-based violence. VAWA provides funding for programs and services that support victims and survivors of domestic violence, as well as legal protections and resources to help prevent these crimes. The title is misleading. The abused person may be a male. The INA incorporates VAWA for the benefit of the immigrant who s a victim of violence.

To file a VAWA self-petition, the applicant must demonstrate that s/he has been subjected to battery or extreme cruelty by the U.S. citizen or permanent resident spouse, parent, or son or daughter. They also need to show that they are a person of good moral character and have resided with the abuser at some point. If approved, the applicant can obtain lawful permanent residency (green card) in the United States.
